Terms of Service – DIGIUTPAD

These Terms of Service ("Terms") govern your use of www.digiutpad.com (the "Website") and the services provided by DIGIUTPAD ("we", "us", "our"), Jhansi, Uttar Pradesh, India. By using the Website or engaging our services, you agree to these Terms.

1. Our services

DIGIUTPAD designs and develops digital products, including websites, landing pages, mobile and web applications, automation tools, custom software and digital marketing services. The exact scope, deliverables, timeline and price for each project are agreed separately in a written quote, proposal or agreement ("Project Agreement").

2. Quotes and payments

Quotes are valid for the period mentioned on them.
Work usually begins after an advance payment as stated in the Project Agreement.
Remaining payments are due as per the agreed milestones. Delivery or launch may be held until dues are cleared.
Prices are exclusive of applicable taxes unless stated otherwise.
Third-party costs (domain, hosting, paid plugins, SMS/WhatsApp credits, app store fees, etc.) are payable by the client unless included in the quote.

3. Client responsibilities

You agree to provide accurate information, content, approvals and access needed for the project on time. Delays in providing these may extend the project timeline. You confirm that any content you provide (text, images, logos) is owned by you or that you have the right to use it.

4. Changes and revisions

Revisions included in the project are stated in the Project Agreement. Any new features or changes beyond the agreed scope may be charged separately.

5. Intellectual property

After full payment, ownership of the final deliverables created specifically for you transfers to you, except for third-party components, open-source software and our pre-existing tools, which remain under their own licences. We may show the completed work in our portfolio unless you ask us not to in writing.

6. Cancellations and refunds

If a project is cancelled after work has started, payment for the work completed up to that point is non-refundable. Any refund of unused advance amounts will be decided according to the Project Agreement.

7. Support and maintenance

Post-launch support is provided for the period mentioned in the Project Agreement. Ongoing maintenance, hosting management or updates after that period may be offered under a separate plan.

8. Limitation of liability

We work with care, but we do not guarantee specific business results such as sales, rankings or leads. To the extent permitted by law, our total liability for any claim is limited to the amount paid by you for the specific service concerned. We are not liable for losses caused by third-party services, hosting outages or circumstances beyond our reasonable control.

9. Use of this Website

You agree not to misuse the Website, attempt unauthorised access, or copy its content or design without permission. Website content is provided for general information and may change without notice.

10. Governing law

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts at Jhansi, Uttar Pradesh.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Website or our services means you accept the updated Terms.
